It is intended to create transparency and, by extension, enable visitors to Klenico<\/span><span data-contrast=\"auto\">\u2019s<\/span><span data-contrast=\"auto\">\u00a0website, users of Klenico<\/span><span data-contrast=\"auto\">\u2019s<\/span><span data-contrast=\"auto\">\u00a0software (<\/span><b><span data-contrast=\"auto\">users<\/span><\/b><span data-contrast=\"auto\">) and patients to gain a clear understanding of what\u00a0<\/span><span data-contrast=\"auto\">data<\/span><span data-contrast=\"auto\">\u00a0relating to individuals<\/span><span data-contrast=\"auto\">\u00a0(<\/span><span data-contrast=\"auto\">also:\u00a0<\/span><b><span data-contrast=\"auto\">personal data<\/span><\/b><span data-contrast=\"auto\">) is processed, by whom and for what purpose.<\/span><span data-ccp-props=\"{\"> <br \/><\/span><\/p><p><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">We attach great importance to data protection. Your personal data is collected and processed in compliance with the applicable provisions of data protection law, particularly the Swiss Federal Data Protection Act (<\/span><span data-contrast=\"auto\">Bundesgesetzes \u00fcber den Datenschutz<\/span><span data-contrast=\"auto\">, DSG) and the General Data Protection Act (GDPR) and their national transposition laws. This Privacy Policy makes reference to the provisions of the GDPR; if data processing is subject to the DSG (e.g. because the clinic and the patient are domiciled in Switzerland), the corresponding (collectively referred to as<\/span><b><span data-contrast=\"auto\">\u00a0clinics<\/span><\/b><span data-contrast=\"auto\">).<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li><\/ul><p><strong>3 Controller<\/strong><\/p><p><span data-contrast=\"auto\">The controller for the collection, processing and use of your personal data, within the meaning of Article 4 (7) GDPR<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0is either Klenico or the clinic\u00a0<\/span><span data-contrast=\"auto\">handling the case<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">In detail<\/span><span data-contrast=\"auto\">, reference is made\u00a0<\/span><span data-contrast=\"auto\">to data-ccp-props=\"{\">\u00a0<\/span><\/li><\/ul><p><strong>4.1 Individual instances of data processing<\/strong><\/p><p><span data-contrast=\"auto\">The software records when a clinic employee sets up new patient files using our software, after logging into our system via \u2018Login myKlenico\u2019. This information is used for\u00a0<\/span><span data-contrast=\"auto\">handling the billing of\u00a0<\/span><span data-contrast=\"auto\">licence fees (<\/span><i><span data-contrast=\"auto\">billing<\/span><\/i><span data-contrast=\"auto\">) between us and the clinic. This data processing is justified by our overriding legitimate interest in carrying out our contract with the clinic.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">In addition, the software records the manner in which the Klenico system is used (<\/span><i><span data-contrast=\"auto\">user analysis, optimisation<\/span><\/i><span data-contrast=\"auto\">) and passes this information on to Klenico; for example, how frequently a particular function is accessed and in what\u00a0<\/span><span data-contrast=\"auto\">sequence<\/span><span data-contrast=\"auto\">\u00a0this occurs. This information is anonymised within the system by being stored without reference to a particular user and by being aggregated to form frequency data. We use this data to study behavioural patterns, which enables us to make improvements to the software (e.g. to user navigation). This means that clinic staff are assisting with the ongoing improvement of our system, which also benefits their work. In terms of the data processing relevant to this, we rely on the justification of our overriding legitimate interest in reviewing and improving our software systems.<\/span><span data-ccp-props=\"{\"> <br \/><\/span><\/p><p><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><b><span data-contrast=\"auto\">4.2 Patient data when the software is used by the clinic<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Klenico does not receive access to patients\u2019 personal data and\u00a0<\/span><span data-contrast=\"auto\">is not aware of<\/span><span data-contrast=\"auto\">\u00a0their identity. This data is stored in the patient database and can only be accessed with a security key that is\u00a0<\/span><span data-contrast=\"auto\">solely<\/span><span data-contrast=\"auto\">\u00a0held by the clinic: see the description of data security measures under item\u00a0<\/span><span data-contrast=\"auto\">7<\/span><span data-contrast=\"auto\">\u00a0below.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">As a result, this means that patient data is solely collected and processed by the clinic, using the system provided, hosted and run by Klenico; neither Klenico nor the server operator, nor anyone else outside the clinic handling the\u00a0<\/span><span data-contrast=\"auto\">case<\/span><span data-contrast=\"auto\">\u00a0in question, sees the name of any patient (unless the patient themselves contacts Klenico to assert their rights as a data subject, for example: see item\u00a0<\/span><span data-contrast=\"auto\">6<\/span><span data-contrast=\"auto\">).<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The following description aims to create transparency as to how the software is actually used by clinics and what data processing procedures occur as part of this:<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p><ul><li data-leveltext=\"-\" data-font=\"Times New Roman\" data-listid=\"38\" aria-setsize=\"-1\" data-aria-posinset=\"0\" data-aria-level=\"1\"><span data-contrast=\"auto\">I<\/span><span data-contrast=\"auto\">n general, the data is collected by specialist medical staff (the doctor handling the\u00a0<\/span><span data-contrast=\"auto\">case<\/span><span data-contrast=\"auto\">\u00a0in question or their assistant) as part of the patient\u2019s self-disclosure (symptom information)\u00a0<\/span><span data-contrast=\"auto\">or\u00a0<\/span><span data-contrast=\"auto\">as part of diagnostic interviews.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li><li data-leveltext=\"-\" data-font=\"Times New Roman\" data-listid=\"38\" aria-setsize=\"-1\" data-aria-posinset=\"0\" data-aria-level=\"1\"><span data-contrast=\"auto\">The patient can be given a tablet with the software for the self-disclosure; in this case,<\/span><span data-contrast=\"auto\">\u00a0the doctor is automatically logged out when they access it so<\/span><span data-contrast=\"auto\">\u00a0the patient can only provide information about their symptoms and not see or use other areas of the software.\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li><li data-leveltext=\"-\" data-font=\"Times New Roman\" data-listid=\"38\" aria-setsize=\"-1\" data-aria-posinset=\"0\" data-aria-level=\"1\"><span data-contrast=\"auto\">Otherwise, the patient can receive an email from the Klenico system with a link to an online survey that they can use to provide symptom information on their own end device. The doctor sending the invitation will be kept up-to-date\u00a0<\/span><span data-contrast=\"auto\">with the response status<\/span><span data-contrast=\"auto\">\u00a0on an ongoing basis in their part of the software. As soon as the symptom information has been completed, the doctor\u00a0<\/span><span data-contrast=\"auto\">is able to<\/span><span data-contrast=\"auto\">\u00a0see the result. The link sent out in the email is automatically deactivated once the symptom information has been provided.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li><li data-leveltext=\"-\" data-font=\"Times New Roman\" data-listid=\"38\" aria-setsize=\"-1\" data-aria-posinset=\"0\" data-aria-level=\"1\"><span data-contrast=\"auto\">Klenico has no control over the emails sent out; it does not know the addresses they are sent to and cannot view them. Klenico solely provides clinics with sample texts for these emails.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li><li data-leveltext=\"-\" data-font=\"Times New Roman\" data-listid=\"38\" aria-setsize=\"-1\" data-aria-posinset=\"0\" data-aria-level=\"1\"><span data-contrast=\"auto\">The automated documentation that is a technical necessity for any email communication is handled by the globally established web<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">service Amazon\u00a0<\/span><span data-contrast=\"auto\">S<\/span><span data-contrast=\"auto\">E<\/span><span data-contrast=\"auto\">S<\/span><span data-contrast=\"auto\">, which keeps appropriate logs. The entire communication process occurs via an SSL-secured connection.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li><\/ul><p><b><span data-contrast=\"auto\">4.3 Anonymous patient data used secondarily by Klenico<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Klenico only receives access to anonymised data from the symptom database (see more\u00a0<\/span><span data-contrast=\"auto\">on this point under<\/span><span data-contrast=\"auto\">\u00a0item\u00a0<\/span><span data-contrast=\"auto\">7<\/span><span data-contrast=\"auto\">\u00a0below) for those patients who have expressly consented to the anonymised use of their symptom data.\u00a0<\/span><span data-contrast=\"auto\">Statistical methods are used to evaluate t<\/span><span data-contrast=\"auto\">hese data strings for scientific purposes and to\u00a0<\/span><span data-contrast=\"auto\">improve the quality of diagnostics. To this end, data is<\/span><span data-contrast=\"auto\">\u00a0automatically anonymised when being<\/span><span data-contrast=\"auto\">\u00a0exported from the symptom database\u00a0<\/span><span data-contrast=\"auto\">so that<\/span><span data-contrast=\"auto\">\u00a0Klenico\u00a0<\/span><span data-contrast=\"auto\">is prevented\u00a0<\/span><span data-contrast=\"auto\">from having any opportunity to access it without prior approval from the patient for this us<\/span><span data-contrast=\"auto\">age<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The clinic collects the above-mentioned consent from the patient in advance. This means that the patient is free to decide whether to provide their health<\/span><span data-contrast=\"auto\">-related<\/span><span data-contrast=\"auto\">\u00a0data to Klenico in anonymised form. The patient can revoke their consent for the anonymised use of their health<\/span><span data-contrast=\"auto\">-related<\/span><span data-contrast=\"auto\">\u00a0data by the clinic or Klenico at any time.<\/span><span data-ccp-props=\"{\"> <br \/><\/span><\/p><p><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><b><span data-contrast=\"auto\">4.4 Hosting<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">All the data is hosted in Switzerland by a specialist server hosting company. The hosting services we use\u00a0<\/span><span data-contrast=\"auto\">serve<\/span><span data-contrast=\"auto\">\u00a0to provide the following services: infrastructure and platform services, computing capacity, storage and database services, security services and technical maintenance services that we use for the purpose of operating the website and the Klenico system.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">To this end, we or our hosting provider process the data listed under items\u00a0<\/span><span data-contrast=\"auto\">4<\/span><span data-contrast=\"auto\">\u00a0and\u00a0<\/span><span data-contrast=\"auto\">7<\/span><span data-contrast=\"auto\">\u00a0on the basis of our legitimate interest\u00a0<\/span><span data-contrast=\"auto\">in\u00a0<\/span><span data-contrast=\"auto\">providing our software and website efficiently and securely pursuant to\u00a0<\/span><span data-contrast=\"auto\">Article\u00a0<\/span><a href=\"https:\/\/dejure.org\/gesetze\/DSGVO\/6.html\"><span data-contrast=\"auto\">6<\/span><\/a><span data-contrast=\"auto\">\u00a0(1) (1) (f) GDPR in conjunction with\u00a0<\/span><a href=\"https:\/\/dejure.org\/gesetze\/DSGVO\/28.html\"><span data-contrast=\"auto\">28<\/span><\/a><span data-contrast=\"auto\">\u00a0GDPR and any other\u00a0<\/span><span data-contrast=\"auto\">grounds<\/span><span data-contrast=\"auto\">\u00a0for justification listed under item\u00a0<\/span><span data-contrast=\"auto\">4<\/span><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{\"> <br \/><\/span><\/p><p><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><b><span data-contrast=\"auto\">4.5 Email contact<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">If you contact us (e.g. via email), we process your details so that we can handle your enquiry and in the event that follow-up questions arise.\u00a0<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">If the data is processed so that steps can be taken prior to entering into a contract as a result of your enquiry or to execute the contract<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">(if your employer is already a client)<\/span><span data-contrast=\"auto\">, the legal basis for this processing is Article 6 (1) (1) (b) GDPR.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">We only process additional personal data if you give your consent for this (Article 6 (1) (1) (a) GDPR) or if we have a legitimate interest in processing your data (Article 6 (1) (1) (f) GDPR). This key is solely held by the clinic in question. For conclusions to be drawn, the data needs to be merged with the patient database<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0which can only be achieved using the security key.
